Introduction

ucrop.it Corporation, domiciled at 16192, Coastal Highway, Lewes, Delaware 19958, County of Sussex, United States of America, and its controlling, controlled and directly and indirectly related companies (collectively referred to as «ucrop.it»), has drawn up this Privacy Policy (the «Policy») to inform the way in which it processes or could process the personal data that it collects or receives from: (i) farmers and their collaborators who register in the Application (the «Farmers»); (ii) ucrop.it customers who have agreed to access and use the Application (the «Customers»); and (iii) reviewers hired by ucrop.it (the «Reviewers», and jointly with the Farmers and Customers, the «Holders»).

When entering and/or using the website https://ucrop.it/ and/or the mobile application called ucrop.it (jointly, the «Application») and/or by providing their personal data to ucrop.it and/or contracting with ucrop.it, the Holders give their free, voluntary, prior, express and informed consent to ucrop.it to process their personal data in accordance with the provisions set out in this Policy.

The free, voluntary, prior, express and informed consent to this Policy by the Holders is an essential requirement for them to be able to use the Application. In order to accept this Policy, the Holders must analyze its terms in their entirety and click on the «I agree» button at the end of this Policy.

Personal Data Collection

ucrop.it collects and processes the Holders’ personal data as confidential, in good faith and in accordance with applicable laws. Unless otherwise provided for in the applicable laws, ucrop.it may collect, process and store in its databases the following personal data (the «Data»), including but not limited to:

Farmers

Registration in the Application:

  • Full name or company name
  • Email address
  • Contact phone number
  • Country of residence
  • National identity card or tax identification code
  • Supporting documents proving authority and/or representation
  • Supporting documents of information provided during registration

Crop Information:

  • Demographic information, location and details of crops
  • Affidavits and related data
  • Digital maps and polygons of fields and plots
  • Geo-located photos of crops, machinery, and agricultural activities
  • Number of plots and hectares per lot, crop, and field
  • Planting plan and annual budget
  • Property titles, lease agreements, and land tenure documents
  • License agreements and tax receipts
  • All other data relevant to agricultural production and sustainable practices

Customers

Registration: full name or company name; email address; contact phone number; country of residence or legal place of business; national identity card or equivalent; supporting documents.

Use of Application: license agreements and information related to the Customer’s fields of interest and compliance with obligations undertaken with ucrop.it.

Reviewers

Registration: full name or company name; email address; contact phone number; country of residence; identification documents.

Use of Application: fields and plots subject to monitoring; results of monitoring activities; agreements entered into with ucrop.it and compliance with obligations.

Purposes for Which ucrop.it Uses the Data

Unless otherwise provided in the applicable laws, ucrop.it may use the Holders’ Data for the following purposes:

  • Registering Holders in the systems
  • Verifying Holders’ identity in compliance with legal requirements
  • Generating traceability from crop cycle data
  • Improving Application services and general management
  • Creating dashboards and crop evidence documentation
  • Profile management
  • Conducting statistical analysis or research with dissociated/anonymized data
  • Compliance with government reports and other legal requirements
  • Promotion and marketing of services
  • Sending advertisements, offers and promotions

Holders have the right to request ucrop.it to stop sending advertisements, offers and/or promotions at any time.

Access to Data

Access to Data is restricted to those persons who must necessarily access them for ucrop.it to provide the services and fulfill the purposes established in this Policy.

Rights — Accuracy of Data — Conservation Periods

Holders may exercise the following rights over their Data:

  • Access
  • Rectification
  • Deletion
  • Exclusion from advertisement lists, offers and promotions
  • Revocation of consent

Notice for Holders residing in the Argentine Republic

The Agency for Access to Public Information (AGENCIA DE ACCESO A LA INFORMACIÓN PÚBLICA), in its capacity as the Control Body under Law No. 25,326, has the power to deal with complaints and claims filed by those whose rights have been affected due to non-compliance with the regulations in force on personal data protection. IN ACCORDANCE WITH ARTICLE 6 ITEM E) OF LAW Nº 25,326, THE HOLDERS MAY AT ANY TIME EXERCISE THE RIGHTS OF ACCESS, RECTIFICATION AND DELETION OF THEIR DATA.

ucrop.it stores Holders’ Data for the time strictly necessary to fulfill the purposes described in this Policy, after which it shall delete or anonymize the Data.

Data Transfer and Assignment

Unless otherwise provided for in the applicable laws, ucrop.it may transfer or assign Holders’ Data to its business partners, related companies, professional advisers, government entities, other Holders and/or service providers, only if necessary for ucrop.it to exercise its rights and for the fulfillment of the purposes that originated their collection or a legal obligation.

Some recipients may be located outside the Holders’ country of residence, including in jurisdictions such as the United States of America, the Argentine Republic, Brazil, Paraguay, and Uruguay. Holders give their consent for ucrop.it to transfer their Data even to jurisdictions whose level of protection may not be equivalent to that of the Holders’ countries of residence.

Processing by Service Providers

When ucrop.it delegates the processing of Holders’ Data to a third-party service provider, both parties shall formalize said processing through a service provision agreement requiring the provider to:

  • Process Data following ucrop.it’s instructions
  • Not use Data for purposes other than those stated in the agreement
  • Adopt necessary technical and organizational security measures
  • Destroy or return the Data once the contractual provision is completed

Databases — Security

ucrop.it stores Holders’ Data in its databases and adopts technical and organizational security measures to avoid adulteration, loss, or unauthorized access. ucrop.it shall not be responsible for illegal interceptions or violations of its systems by unauthorized persons.

Cookies

The Application and ucrop.it advertisements may use «cookies» or other similar technologies (e.g., «web beacons») to track geographical location and behavior, quantify advertisement effectiveness, analyze trends, and administer the Application. Holders may deactivate cookies, though this may limit their ability to use certain Application functionalities.

The Application may contain links to third-party websites or applications. Data processing carried out by such third parties is not covered by this Policy, and ucrop.it has no control over and shall not be responsible for such sites and applications.

Holders That Use the Application

ucrop.it may provide Holders with certain Data of other Holders who use the Application. Each Holder receiving or accessing Data from other Holders agrees to use such Data in compliance with applicable laws and shall indemnify and hold harmless ucrop.it from any claim arising from misuse of such Data.

Minors

ucrop.it refrains from knowingly collecting Data from individuals under eighteen (18) years of age. If identified, such Data will be immediately deleted.

Policy Changes

If ucrop.it decides to modify this Policy, it shall notify Holders as soon as possible through a new privacy policy sent to the email addresses provided. If Holders do not agree with the new policy, they should not use the Application or the services.

Applicable Law — Jurisdiction

This Policy is governed by the laws of the State of Delaware, United States of America. For any controversy or conflict, ucrop.it and the Holders submit to the exclusive jurisdiction of the federal and state courts of the State of Delaware, United States of America.
